As we approach winter and temperatures drop below 10 degrees, rental properties may begin to show signs of deterioration, including issues like damp and mould.

It's crucial for tenants (now known as contract-holders in Wales) to understand their rights and responsibilities during this season.

Cold weather can take a toll on the property, and there are essential steps every tenant should take to ensure a safe and comfortable living environment.

Mark Woloshak, Head of Litigation urges tenants to stay alert this winter, sharing signs for tenants to look out for regarding common cold weather issues so they can get ahead of potential problems:

1. Check your boiler to stay warm

One of the main concerns during the colder weather is heating. A significant drop in the outside temperature can affect the pipework and heating systems in the home. To ensure a safe and secure living space, tenants should check that their boiler is working correctly. If there are any suspected issues, report them to your landlord immediately.

2. Watch out for frozen water pipes

Another issue to look out for is frozen water pipes. Icy pipes can lead to burst pipes, water damage, mould, and increased utility bills. Tenants can prevent this by maintaining adequate heating within the property.

3. Dampness

Damp can be difficult to detect but is a common issue for homes during the cold months. If present, damp can significantly affect your comfort and will increase your energy bills unnecessarily.

As well as that, it can also cause mould on your clothes, shoes and other personal items.

As occupiers, tenants can help ensure they continue to live in a safe and warm environment by staying alert and keeping an eye out for potential issues in the run up to winter.

Remember that communication with your landlord is essential, and you have rights as a tenant to a well-maintained and habitable property.

The landlord is responsible for addressing maintenance concerns, and a fast response is vital, especially if there's a significant risk to the tenant's health and safety.

We strongly advise tenants to maintain open communication with their estate agent or landlord, ensuring that any alterations or issues concerning the property can be traced. This practice can prove invaluable should any questions arise in the future.

If the landlord refuses to address the issues they may escalate, possibly resulting in additional harm to the residence. For instance, if a crack remains unattended and severe weather conditions, such as storms or heavy rain occur, water may enter the property, potentially causing damage to personal belongings.

Landlords should also ensure that they act on any concerns raised by their tenant. Failure to do so could result in damages claims against them and/or lost rent.
