Cancer Misdiagnosis Claims
Receiving a diagnosis of cancer can be devastating. However, this trauma can be escalated if your cancer was misdiagnosed or diagnosed later than it should have been, and you may be able to claim for compensation.
Do I Have a Claim for Cancer Misdiagnosis?
You may be eligible for cancer misdiagnosis compensation, if:- There’s a delay in diagnosing an illness
- There’s a delay in treatment
- You’ve had the wrong treatment, or the treatment goes wrong

Diagnosis of cancer can be overwhelming for a patient and their family at any time, but this news can be even more distressing if there has been a delay in discovering the illness.
If there is a delay in diagnosis, this may impact on life expectancy, the treatment options that are available and how long treatment lasts.
Quite often no-one is to blame for an apparent delay in diagnosis of cancer. However, sometimes things go wrong; for example, delays can be caused by a GP failing to refer a patient to hospital for further investigation.
Hospitals can also be at fault by failing to follow up test results or incorrectly reporting x-rays.
Following negations with the defendant, Mr X was offered £250,000 gross of the interim payments of £52,009 to settle the claim. Mr X accepted this offer and was very thankful for our assistance with his claim.

Case Study: Medical Malpractice Failure to Diagnose Cancer
D v Chelsea & Westminster NHS Foundation TrustA claim arose out of a negligent delay in the diagnosis of terminal renal cancer which could otherwise have been avoided. Damages were awarded for pain, suffering and loss of amenity, in addition to a significant award for future end of life care and adaptations.
The claim was settled for £330,000.00.
M v Cwm Taf University Health Board
This claim related to the misdiagnosis of cancer on the claimant’s nose, which later transpired to be an insect bite. Unfortunately the hospital was negligent to assume the lesion was cancerous without first referring the claimant to dermatology for a biopsy sample. The hospital proceeded to undertake incision surgery to the claimants nose to remove the suspected cancer, sadly this resulted in significant scarring to the claimant’s face and nose for which plastic surgery was required on multiple occasions. Upon the hospital testing the removed lesion it transpired that it was non-cancerous and that the claimant could have avoided surgery altogether. Despite the efforts of multiple plastic surgeons the claimant was left with lifelong scarring to their face.
We were able to secure compensation for the claimant in the sum of £25,000.00 before Trial.
