Medical Malpractice Claims for Infections

Gaining an infection due to poor treatment or even contracting one in hospital can severely damage a patient’s health.

Negligent infection can happen not only within hospitals and doctor’s surgeries, but also at the dentists and even care homes. This can happen if there are no strict procedures in place to prevent infection.

How Can Negligent Infection Occur?

Within a hospital or doctors’ surgery, negligent infection can be caused by:
  • Placing someone with a known infection onto a general ward (i.e. not quarantined)
  • Failure to uphold cleaning regulations/regimes and standards (i.e. not washing bedding/correct removal of dirty/used instruments or bedding)
  • Using dirty operating tools or not ‘scrubbing’ prior to surgery
  • Viral outbreak
  • Negligent performance of surgery
  • Failure to adequately treat/medicate
Due to the increased number of people in such close environments, infections are more likely to spread. Especially if regulations and high cleaning standards are not always maintained, this could result in an infection due to medical negligence.

Outside of a hospital or doctors’ surgery, negligent infection can be caused by:
  • Failure to recognise an infection or diagnose symptoms of an infection
  • A delay or resistance to recognise infection
  • Delay in provision of treatment or antibiotics
  • Poor wound management
Following negations with the defendant, Mr X was offered £250,000 gross of the interim payments of £52,009 to settle the claim. Mr X accepted this offer and was very thankful for our assistance with his claim.
