Prescription Medical Negligence


Getting a prescription from a nurse or doctor appears to be one of the most basic medical procedures. Unfortunately, many errors can arise when it comes to prescribing drugs, and this can sometimes have devastating effects. In very extreme cases, it can even result in patient fatality.

Case Studies: Mis-Prescription of Medication Claims

S v Cardiff & Vale University Health Board

This involved an adverse reaction resulting in a 4 – 6-week period of vomiting and diarrhoea caused as a result of incompatible medication being prescribed – ‘contraindication’. Damages were awarded for pain, suffering and loss of amenity to the sum of £5,000.00.

C v Taunton and Somerset NHS Foundation Trust

A claim arose out of the negligent ‘mis-prescription’ of medication for a 6-month period resulting in discomfort and relatively minimal harm. Damages were awarded for pain, suffering and loss of amenity to the sum of £3,500.00.
