When buying a new house, you will want to know what the legal cost is going to be, how long it will take and who will be dealing with your matter.

A typical case

The service that we offer for conveyancing is charged on a fixed fee and not on a time recorded basis. Our fees and the disbursements are naturally influenced by the value of the property, the complexity, the services required and any extraneous factors.

Whilst no two property transactions are the same in order to give you a flavour of what our fees would be to act in the purchase of a freehold registered property for £250,000.00 where no mortgage is involved, then please click here.

Service

The services included within this fee includes;

  1. Opening a file and completing our compliance and professional obligations to provide you with an engagement letter, breakdown of fees and expenses, terms and conditions or business;
  2. Satisfying our obligations pursuant to the Anti-Money Laundering Regulations;
  3. Investigating the Title to the Property, ordering and reviewing searches and raising enquiries;
  4. Agreeing the contract and Transfer Deed;
  5. Exchanging contracts and agreeing the date for completion of the purchase to take place;
  6. Preparing a statement showing the balance of monies required to complete the purchase;
  7. Sending the money to the seller’s solicitor on the day of completion
  8. Registering the Property at the Land Registry;
  9. Attending to the payment of any Stamp Duty Land Tax if the property is in England, or Land Transaction Tax if the property is in Wales.

Disbursements

Disbursements are third party costs and expenses required in the conveyancing purchase transaction. We will pay the disbursements on your behalf to help expedite the transaction. The disbursements which are incurred in a conveyancing purchase vary depending on the circumstances but we have listed below the most common disbursements.

Searches – If you are purchasing a property for cash then you do not require any searches, however we strongly recommend that you have them.

If you are purchasing with a mortgage the lender will require that searches on the property are applied for.

The cost of searches is influenced by which local authority the property is located in and any specific requirements your lender may have. The typical searches in a conveyancing transaction would include the local authority, water and drainage and environmental. The fees for the searches vary according to search provider and which pack is necessary for your property/mortgage lender and the search fees range from £120 – £335 plus VAT

Stamp Duty Land Transaction (England)/Land Transaction Tax (Wales) – this is personal tax which may be payable depending upon;

The property Price, where the Property is situated, your personal circumstances, whether you are replacing your principal main residence, whether you are an individual or a company, whether you or the Property qualify for any exemptions or incentives.

Land Registry Fees – the Land Registry have set fee scales for their registration service depending on the circumstances – please see the following link. The price of the Property, whether the property is already registered at the Land Registry, whether it is freehold or leasehold and whether the Property you are buying is the whole of an existing registered title or only part will influence the fee that the Land Registry charge.

Additional Fees and Disbursements

The fee put forward in the example above assumes that the title to the property is already registered at HM land registry and further that there are no defects with it. Additional charges will be incurred where we have to deal with problems arising out of such transactions. In the majority of our cases, the fixed fee provided at the start of the transaction will be the final fee payable. Depending on the complexity of the case these fees can vary. Rather than confuse you with a list of these charges, the majority of which will not apply, we will inform you of any additional costs during the transaction if any are relevant. No additional fees are ever charged to our clients unless they are fully discussed and agreed with the client before hand.
