What Is the Divorce Process in England and Wales?
Since the introduction of no-fault divorce in April 2022, couples no longer need to assign blame. Instead, you simply confirm that the marriage has irretrievably broken down.
This has simplified the process, making it more straightforward and less confrontational.
A divorce typically takes around 6–7 months minimum, although it can take longer if finances or children are involved.
The Key Stages of the Divorce Process
1. Filing a Divorce Application
The process begins with submitting a divorce application online or by post. You can apply:
- Individually (sole application), or
- Together with your spouse (joint application)
The application confirms that your marriage has irretrievably broken down.
2. Acknowledgement of Service
If you apply alone, your spouse will receive the application and must respond (usually within 14 days).
In most cases, divorces are not contested, allowing the process to move forward smoothly.
3. The 20-Week Reflection Period
Once the application is issued, there is a mandatory 20-week “cooling-off” period before progressing further.
This time allows both parties to:
- Reflect on their decision
- Begin discussions about finances
- Make arrangements for children
4. Conditional Order
After the 20-week period, you can apply for a Conditional Order (previously called Decree Nisi).
This confirms the court sees no legal reason why the divorce cannot proceed.
5. Final Order (Divorce Completion)
Six weeks and one day after the Conditional Order, you can apply for the Final Order, which legally ends your marriage.
At this stage, you are officially divorced.
What About Finances and Children?
It is important to understand that divorce itself does not resolve financial matters or child arrangements.
You will usually need to:
- Agree a financial settlement (Consent Order), or
- Apply to the court for a financial order if no agreement is reached
Similarly, arrangements for children should be agreed separately, either through negotiation, mediation, or court proceedings if necessary.
How Long Does Divorce Take?
In most cases, divorce takes at least 26 weeks (around 6 months) due to the mandatory waiting periods.
However, delays can occur if:
- Financial disputes arise
- One party does not respond
- Court proceedings are required
How Much Does Divorce Cost?
The standard court fee for a divorce application is currently £612.
Additional costs may include:
- Solicitor fees
- Mediation costs
- Court applications for financial or child arrangements
Do You Need a Solicitor for Divorce?
While it is possible to manage a divorce yourself, legal advice is strongly recommended—especially where there are:
- Children involved
- Property or pensions to divide
- Disputes between parties
A solicitor can ensure your rights are protected and help avoid costly mistakes.
