Lasting Power of Attorney
Ensure the right person can make decisions for you, if you’re no longer able to, with the help of our Lasting Power of Attorney (LPA) solicitors.
A Lasting Power of Attorney is a legal document which allows individuals to choose someone to make decisions on their behalf about such matters as property, financial affairs and health, at a time when they lack the mental capacity to make those decisions for themselves.
There is always a risk that an accident, health problem or cruel twist of fate can drastically affect mental and physical wellbeing. With a Lasting Power of Attorney in place, you can ensure your interests are protected by a trusted friend or family member.
How we can help
The Lasting Power of Attorney has two elements which can be made separately or together:
The property and affairs Lasting Power of Attorney
This allows you to choose an individual you trust to make decisions about how to spend your money and the way your property and affairs are managed.
Once registered at the Office of the Public Guardian, and unless you have put a restriction on it, this type of LPA can be used by your attorneys straight away.
This effectively replaces the old Enduring Power of Attorney.
The personal welfare Lasting Power of Attorney
The Personal Welfare LPA allows you to appoint an individual to look after your personal welfare and healthcare.
This effectively replaces what was commonly known as the ‘Living Will’.
It will only be possible for your attorney to make these decisions for you if you are no longer mentally capable of making these decisions yourself.
