Our divorce settlement solicitors can guide you through the complex and emotional process of separating your assets at the end of a marriage.

When parties are separating, they often find things very stressful, and it can be a very anxious time. It is vitally important that parties seek legal advice as soon as possible after the breakdown of the marriage.

One thing we find out about as divorce lawyers is that parties sometimes deal with the divorce but fail to deal with the financial position. They often assume that because the divorce has gone through that there is no further work to be done in respect of finances. This is incorrect.

It is vitally important that parties deal with the financial side of their relationship as both parties have live claims against each other before the Family Court. To deal with the matter a negotiation needs to take place with a view to try and achieve a settlement in respect of the finances. Our divorce financial settlement solicitors can help facilitate this.

How we can help

If a settlement is reached, then our divorce settlement solicitors will prepare a Consent Order setting out the terms of the settlement which can be forwarded to the Court for judicial approval. If the Judge believes that the Order is fair, then it will be approved and both parties will be legal bound by the terms of the Order.

Clean Break clauses within Orders are very common. A Clean Break means that neither party can make a claim against the other in future and a Clean Break clause will specify what claims are no longer available.

Clean Break Orders are technical because they need to specify what Orders neither party can claim for in future. If it is not properly specified, then there is a risk that there will be an opportunity for the other party to make a further application to Court.

Our aim is to assist you from the outset by trying to broker an agreement with the other party by engaging with them or their solicitors. There are a variety of way to do this such as Correspondence, Round the table meetings and mediation.

If no agreement can be reached or the circumstances warrant a more robust approach, we can make an application to court and represent you throughout the proceedings.

If you are considering, or have recently gone through, a divorce, please don’t delay in reaching out to our friendly team for settlement advice.
