Unfair dismissal
Being an employer isn’t easy. Managing employees needs skill and patience. If you have a dispute with an employee, you will need to have the support and guidance to make sure that a problem doesn’t become a claim. Howells has the expertise to guide you through discipline and grievance proceedings, as well as performance and sickness absence management. The aim is to help you resolve these matters internally, move on and do what you do best.
If that isn’t possible, and dismissal is unavoidable, you may need access to legal experience and knowledge that you can trust. Whether its support with dealing ACAS Early Conciliation, helping mediate, negotiating a resolution, or assisting with an appeal against dismissal, we can assist.
It may be possible to prevent the situation reaching an employment tribunal, saving you time, stress, and money, as well as damage to reputation. But if you do have to face defending an Employment Tribunal claim, Howells can help you navigate what can be a daunting process and achieve the best possible outcome with pragmatic, commercial and expert advice.
How we can help
Unfair dismissal can occur for several reasons and in a range of circumstances. If you have dismissed a staff member, it may constitute unfair dismissal if:
- You fail to provide a fair reason for the dismissal
- You fail to follow the correct procedure
- You dismiss an employee for an ‘automatically unfair’ reason like a request for maternity leave
In addition to unfair dismissal claims, we also offer expert advice and representation in defending other Employment Tribunal claims such as; –
- Unlawful deduction of wages
- Claims relating to discrimination
- Claims relating to a protected disclosure
- Wrongful dismissal claims

If you have dismissed an employee unfairly, or have been wrongfully accused of such an action, we can help.
We work hard to settle unfair dismissals without the need for employment tribunal cases. Using negotiation, mediation and settlement agreements, we strive to achieve the best possible outcome. However, should it come to it, we have the expertise and experience to represent you in an employment tribunal.
